近日，一起涉及跨境攜帶淫穢出版物入境的案件經法院審理後作出判決。被告汪某（40餘歲）因從日本購買並攜帶大量標註「十八禁」的成人漫畫入境，被認定構成走私淫穢物品罪，依法判處有期徒刑一年六個月。

據法院審理查明，汪某在境外購得共計244本成人向漫畫作品，並以「人肉攜帶」方式自日本入境時未依法申報。相關出版物經鑑定屬於中國法律認定的淫穢物品範疇。

案件材料顯示，上述物品數量較大，已超出個人合理使用範圍，具備明顯違法性質。法院認為，被告明知相關物品屬於受限制或禁止流通的出版物，仍攜帶入境，其行為已構成走私淫穢物品罪，依法應予懲處。法院在量刑時綜合考量案件數量、情節及被告認罪態度，最終判處汪某有期徒刑一年六個月。目前，該判決已依法生效。

Cross-Border Smuggling of Obscene Publications Case Sentenced: Woman Received 18 Months in Prison

A court has recently concluded a case involving the illegal importation of obscene publications from Japan. The defendant, a woman surnamed Wang in her 40s, was sentenced to one year and six months in prison for the crime of smuggling obscene materials into the country.

According to court findings, Wang purchased a total of 244 adult-oriented comic books in Japan, many of which were explicitly marked as “18+” and contained sexually explicit content. She subsequently transported these materials back to China through personal luggage, failing to declare them at customs upon entry.

The court determined that the seized materials were classified as obscene publications under Chinese law. Given the large quantity involved, the items were deemed to exceed the scope of personal use and constituted a serious violation.

The court further stated that the defendant knowingly transported prohibited materials across the border, thereby meeting the legal elements of the crime of smuggling obscene publications.

In sentencing, the court considered factors such as the quantity of the materials, the nature of the offense, and the defendant’s admission of guilt. Wang was ultimately sentenced to 18 months in prison.The judgment has now taken legal effect.
